Did Michael D. Barrett ';rape'; Erin Andrews by secretly videotaping her nude in the privacy of her hotel room?

If Michael D. Barrett is convicted, I know it's not technically a ';rape'; criminal case; but it's like a rape, in the sense that a person's (Erin Andrews) physical being was violated by being videotaped naked without her permission.

There is a crime here, but what is the punishment?Did Michael D. Barrett ';rape'; Erin Andrews by secretly videotaping her nude in the privacy of her hotel room?
No, her physical being was definitely NOT violated. Her mental and psychological being was. That is definitely not rape.

Barrett faces charges of interstate stalking for allegedly taking videos of Andrews in her hotel rooms while she was covering sporting events, trying to sell them to celebrity Web site TMZ and posting the videos online. The charges carry a maximum penalty of five years in prison and a $250,000 fine.Did Michael D. Barrett ';rape'; Erin Andrews by secretly videotaping her nude in the privacy of her hotel room?
It's an invasion of privacy and would violate peeping Tom laws.

Please, let's save the word ';rape'; for actual sexual assaults. What happened here is serious and wrong, but not the same as an actual assault. Nothing is ';like a rape'; except rape.
No, he didn't rape her, obviously. It was an invasion of privacy. What should the punishment be? The maximum punishment available.
